Terms of Service
1. Who we are
JiPro is operated by Enerik Bishani, an individual developer established in Belgium ("JiPro", "we", "us"). Contact: support@jipro.app.
When the company that will operate JiPro is registered, it will take over these Terms (section 19) and this section will be updated.
2. These Terms
These Terms of Service ("Terms") govern your use of the JiPro apps, the website jipro.app and related services (the "Service"). The Privacy Policy (https://jipro.app/privacy) explains how we process personal data. By creating an account you accept these Terms; please read them first. They are available at any time at https://jipro.app/terms.
If you use JiPro as a consumer, nothing in these Terms limits the rights you have under mandatory consumer law, in particular Book VI of the Belgian Code of Economic Law and the rules on the conformity of digital content and services.
3. Who can use JiPro
- You must be at least 16 years old to create an account.
- If you are under 18, you may only use JiPro with the permission of a parent or legal guardian, who accepts these Terms on your behalf and is responsible for supervising your use.
- Give accurate information and keep it up to date. Accounts are personal; do not share, sell or transfer yours.
- Keep your login secure. You are responsible for activity under your account unless it results from our fault or from unauthorised access you could not reasonably prevent. Tell us promptly at support@jipro.app if you suspect misuse.
4. What JiPro does, and what it does not do
JiPro helps you plan and organise trips, keep track of and split shared costs, prepare packing lists, share travel content and stay in touch with travel companions.
- JiPro is not a travel agent or booking service. We do not sell, book, change or cancel flights, accommodation or other travel services and are not a party to your contracts with airlines, hotels or other providers.
- Travel information must be checked. Flight times, check-in deadlines, airport and time-zone data, maps, directions, places, opening hours, exchange rates and descriptions come from you, other users, AI processing or third parties and can be incomplete, outdated or wrong. Always confirm important details, including check-in, boarding, passport, visa, health and entry requirements, with the airline, provider or official authority. Reminders and notifications are a convenience and can be delayed or not delivered; do not rely on them as your only reminder.
- JiPro is not a payment service. Split bills, balances, payment requests and claims are records only. We do not hold or transfer money and are not responsible for whether other users pay you. Currency conversions are indicative.
- JiPro is not an emergency or navigation-safety service.
5. AI-assisted import
Booking import uses an AI model provided by Google to read the screenshot or text you submit (see Privacy Policy, section 5). AI output can be wrong. Check and correct the extracted details before you rely on them, and only submit content you are entitled to share.
6. Price
JiPro is currently free. If we introduce paid features, we will show the price, the main characteristics, the duration and your withdrawal rights clearly before you pay. Purchases through the App Store or Google Play are also subject to their terms.
7. Quality of the Service and legal guarantee
We provide the Service with reasonable care and skill and keep it secure and up to date. If you are a consumer, you benefit from the legal guarantee of conformity for digital content and digital services (Belgian Civil Code, articles 1701/1 and following), including when you receive the Service in exchange for providing personal data. If the Service is not in conformity, contact support@jipro.app and we will bring it into conformity within a reasonable time; if that is not possible, you have the remedies the law gives you.
We may change the Service, for example to add or remove features, for security or legal reasons, or to improve it. If a change has more than a minor negative effect on your access to or use of the Service, we will inform you in advance and you may terminate the contract free of charge within 30 days, as provided by law.
8. Your content
- Ownership. You keep all rights in the content you add (trips, photos, videos, messages, captions, "Your Content").
- Licence to us. You grant JiPro a non-exclusive, worldwide, royalty-free licence to host, store, copy, process, adapt (for example resize) and display Your Content, only to provide and secure the Service for you and for the people you share it with. We may let our service providers do this on our behalf. The licence ends when Your Content is deleted, except for copies kept in backups for their limited lifetime and where we must keep content by law.
- Your responsibility. You must have the rights to what you share, and it must not infringe others' rights or the law. If your content shows other people, you are responsible for having their permission where needed.
- Shared content and deletion. What you share is visible according to your settings and the feature used. When you delete content or your account, it is also removed for the people you shared it with, as described in section 13.
9. Rules of conduct
You must not:
- break the law, or use the Service for fraud or deception;
- harass, threaten, stalk, bully, discriminate against or impersonate anyone;
- share illegal content, sexually explicit content, content that sexualises or endangers minors, content that promotes violence, terrorism or self-harm, or hate speech;
- share other people's personal data, location or images without their permission;
- infringe intellectual property, privacy or other rights;
- send spam or unsolicited advertising, or create fake or automated accounts;
- access the Service by bots or scrapers, overload it, probe or bypass its security, or reverse-engineer it except where the law allows;
- misuse the AI features, invitations, reports or other users' trips.
10. Content moderation, notices and complaints
JiPro stores information provided by its users, and for public accounts and public stamps makes some of it available to other users. It is therefore an intermediary "hosting service" under Regulation (EU) 2022/2065 (the Digital Services Act, DSA), and may also qualify as an "online platform". JiPro is operated by a micro enterprise; under Article 19 DSA, the additional obligations for online platforms in Articles 20 to 28 (except Article 24(3)) do not apply to micro and small enterprises. The rules below describe what we do.
- How to report. In the app you can report a direct message, a group-chat message or a user, and you can block users. For any other content, including stories, photos or profiles, or if you do not have an account, send a notice to support@jipro.app. A notice about illegal content should contain: where the content is (for example the user and what you saw); why you consider it illegal; your name and email address (not required for notices about child sexual abuse material); and a statement that you believe in good faith that the notice is accurate and complete. We confirm receipt of email notices and tell you what we decided (Article 16 DSA).
- How we decide. Reports are reviewed by a person; we do not use automated systems to take moderation decisions (automatic rate limits only slow down excessive use). We act diligently, objectively and proportionately. We may remove or restrict content, limit features, or suspend or terminate accounts that, in our reasonable judgement, break these Terms or the law.
- Statement of reasons. If we restrict your content or account, we tell you which content or account is affected, what we decided, the facts and the rule (law or these Terms) we relied on, that the decision was not taken by automated means, and the ways you can seek redress (Article 17 DSA), unless the law prevents us from doing so.
- Asking us to review a decision. You can ask us to reconsider a moderation decision, or our decision on your notice, by writing to support@jipro.app within six months of being informed of it. We will review it and tell you the outcome and the reasons. We offer this voluntarily (see Article 19 DSA above).
- Other ways to seek redress. You can always go to court. You can also lodge a complaint about an alleged breach of the DSA with the Digital Services Coordinator of the EU country where you live or are established (Article 53 DSA); in Belgium this is the Belgian Institute for Postal Services and Telecommunications (BIPT). A Digital Services Coordinator is a regulator and does not settle individual disputes. Because JiPro is operated by a micro enterprise, it is not required to take part in out-of-court dispute settlement under Article 21 DSA. For consumer disputes, see section 18.
- Serious crimes. If we become aware of information giving rise to a suspicion that a criminal offence involving a threat to the life or safety of a person has taken place, is taking place or is likely to take place, we inform the competent authorities (Article 18 DSA).
- Repeated misuse. After a warning, we may suspend for a reasonable time accounts that frequently share manifestly illegal content, and we may stop handling reports from people who frequently submit manifestly unfounded ones.
- Points of contact. Our single point of contact for users (Article 12 DSA) and for the authorities of the EU Member States, the European Commission and the European Board for Digital Services (Article 11 DSA) is support@jipro.app. You can communicate with us in English, and also in Albanian.
11. Our intellectual property
The Service, its software, design, the JiPro name and logo, and content we provide (excluding Your Content and third-party data) belong to us or our licensors. We give you a personal, non-exclusive, non-transferable, revocable right to use the app for your own non-commercial purposes in line with these Terms. Map, place and photo data is provided by third parties under their licences and attributions.
12. Third-party services
The Service uses and links to third-party services (for example Apple, Google, Mapbox, Foursquare, OpenStreetMap, Wikipedia and navigation apps). Their own terms apply to your use of them, and we are not responsible for their content or availability, except where the law makes us responsible.
13. Your data, export and deletion
You can export your data at any time in Settings → Export my data, and delete your account in Settings → Delete account. Deleting your account works as follows (this is the same text as section 8 of the Privacy Policy):
- Requesting deletion: in Settings → Delete account. You are signed out on that device and your account is scheduled for deletion.
- During the next 30 days: your account is hidden: other users cannot find you in search, see your profile, stories or highlights, find you in follower lists, or start following you. Trips, group chats, split bills and direct-message conversations you already share with others stay visible to their members until the final deletion, so their records keep working. Your data is kept unchanged so you can come back.
- Restoring: if you sign in during the 30 days, JiPro shows the date your account will be deleted and asks whether you want to restore it. Choosing "Restore my account" cancels the deletion and makes your account visible again; choosing to keep the deletion signs you out. Signing in alone does not cancel the deletion.
- After 30 days: an automated process that runs every day permanently deletes your account and, with it: your profile and profile photo; trips you own, for all their members, including their plans, group chats, photos and receipts; photos and videos you added to other people's trips, your stories, highlights and passport photos; every direct-message conversation you took part in, for both participants; messages you sent in trip group chats; your follows, likes, votes, invitations and trip memberships; and your settlements, payment requests and shares in split bills, so the balances of the trips concerned no longer include you. Split bills that you paid in other people's trips stay in those trips' records, without your name. If a step fails, the process retries it the next day.
- Deletion record: we keep a minimal record that deletion was requested and carried out (dates and any reason you typed), no longer linked to your account, to demonstrate that we honoured the request.
- Backups: deleted data can remain in backups held by our hosting provider only until those backups expire on their regular cycle. We do not restore deleted accounts from backups.
14. Ending the contract
- You can stop using JiPro and delete your account at any time, without giving a reason and free of charge.
- We can suspend or end your access if you seriously or repeatedly breach these Terms, if the law requires it, or if your use puts users or the Service at serious risk. Except in urgent cases or where the law prevents it, we will warn you first, give reasons, and allow you to export your data.
- We can end the Service as a whole with at least 60 days' notice, during which you can export your data.
15. Liability
- We are liable according to the law for damage caused by our fault. Nothing in these Terms excludes or limits our liability for death or personal injury, for fraud, for intentional misconduct or gross negligence, for failure to perform an essential obligation of the contract, or any other liability that cannot be excluded or limited by law, nor any right you have as a consumer.
- We are not liable for damage that is not caused by us, in particular: decisions by airlines, hotels or other providers; the content and conduct of other users and third parties; debts between users; or the consequences of relying on information you did not verify where these Terms ask you to do so.
- If you use JiPro for business or professional purposes, and only then, we are not liable for indirect or consequential damage or loss of profit, and our total liability is limited to EUR 100 per year, except in the cases listed in the first point.
16. Claims by third parties
If a third party brings a claim against us because of content you shared or because you breached these Terms or the law, you are responsible for the resulting damage in accordance with the law. If you use JiPro for business or professional purposes, you will also reimburse our reasonable costs of defending such a claim.
17. Changes to these Terms
We may update these Terms for valid reasons, such as changes to the Service, the law or security needs. We will inform you at least 30 days before material changes take effect (unless a change is required by law or urgently needed for security) and explain what changes. If you do not agree, you can delete your account before the changes take effect. Each version has a number and an effective date; previous versions are available on request.
18. Governing law and disputes
- These Terms are governed by Belgian law. If you are a consumer living in another country, you also keep the protection of the mandatory rules of that country, and you can bring proceedings in the courts of the place where you live.
- Please contact support@jipro.app first; we will try to resolve the issue within 30 days.
- Consumers can also turn to the Belgian Consumer Mediation Service (consumentenombudsdienst.be / mediationconsommateur.be) for out-of-court dispute resolution.
19. Transfer to the operating company
We may transfer this contract to the company that will operate JiPro or to another successor, provided your rights are not reduced. We will inform you in advance. You may not transfer your rights without our consent.
20. App store terms
If you downloaded JiPro from Apple's App Store, these Terms are between you and JiPro, not Apple. Apple is not responsible for the app or its content and has no obligation to provide maintenance or support. To the maximum extent permitted by law, Apple has no other warranty obligation regarding the app; if the app fails to conform to an applicable warranty, you may notify Apple, which may refund the purchase price, if any. Apple is not responsible for addressing any claims relating to the app, including product liability, failure to meet legal or regulatory requirements, consumer protection, privacy or intellectual property claims; we are responsible for those to the extent required by these Terms and the law. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist-supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. If you downloaded JiPro from Google Play, Google Play's terms also apply to the download.
21. General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Service.
- Severability. If a provision is invalid, the rest remains valid, and the invalid provision is replaced by a valid one as close as possible to its purpose, to the extent the law allows.
- No waiver. Not enforcing a right does not mean we give it up.
- Force majeure. Neither party is liable for failures caused by events beyond its reasonable control.
- Language. These Terms are in English. If we provide translations, you can rely on the version in your language where the law gives you that right.
